$Moderna (MRNA.US)$ Winning a judgement to not invalidate patents based on standing is a long way from winning a judgement to enforce a patent infringement. This seems overstated here. Royalties could happen but we are not close to that point right now.

  • BraveRoy : Moderna sued ABUS to invalidate the patents. They prospectively knew if these patents stand, they will be liable for infringment. Now that they lost 2 validity patent appeals, I doubt they will wait for a court judgement to enforce infring payments. They could lose HUGE in court ($2-8 B has been forecast), so they'll likely negotiate a settlement soon. Or even consider a buyout. Pretty amazing that Bancel had opp to buy ABUS fo $175M pre-COVID.

  • BSqueen BraveRoy : Indeed, well said, it is MODENRA who started the fight to invalidate the ABUS patent. why would they initiate it in the first place? they knew it would be a big obstacle in ahead of all of their pipelines ; )

    Could eventually see a huge sell-off. Waiting patiently for that huge spiral down, as that Market cap is absolutely ridiculous and unsustainable imo.

  • YYYoung : I skimmed the court ruling. The moomoo summary is either incorrect or I didn't read it correctly. The court said, yes, Moderna has "standing" because it is pretty obvious they will be sued by ABUS. However the court did not agree with Moderna that the ABUS patents could be overturned because they were obvious. So court affirmed the US patent board ruling that the patents are valid and Moderna is about to be sued.
