According to the WeChat public account 'Shi Shuo Xin Yu' of the State Administration for Market Regulation, as of December 11th, Fast Technology reported NVIDIA for suspected violation of the Anti-Monopoly Law of the People's Republic of China and the announcement of the State Administration for Market Regulation on the Anti-Monopoly Review Decision of the approval of NVIDIA's acquisition of Mellanox Technologies Ltd. (State Administration for Market Regulation Notice [2020] No. 16), the State Administration for Market Regulation has initiated an investigation into NVIDIA.
NVIDIA responded to the investigation by stating, 'NVIDIA wins through strength, reflected in our benchmark test results and the value to our customers, who can choose the solution that best suits them. We strive to provide the best products in every region and uphold our commitments wherever we operate. We are happy to address any questions regulators may have about our business.'
If NVIDIA's monopoly behavior is confirmed, it will face fines of more than one percent but less than ten percent of the previous year's sales, up to a maximum of fifty billion US dollars.
Some experts have pointed out that in recent years, NVIDIA has ceased the supply of several GPU accelerators to China, citing the US government's expanding semiconductor export controls. This has infringed upon the legitimate rights and interests of relevant Chinese enterprises, resulting in widespread dissatisfaction within the industry. NVIDIA is suspected of violating anti-monopoly regulations, and the State Administration for Market Regulation's investigation into them comes as no surprise.
From a practical standpoint, NVIDIA's acquisition of Mellanox has strengthened its global market advantage, with NVIDIA cutting off supply to the Chinese market, causing tangible competitive harm. This situation must be corrected and mitigated as soon as possible.
The State Administration for Market Regulation's investigation into NVIDIA is an independent and professionally enforced action under a high standard of openness to the outside world.
The State Administration for Market Regulation initiated a case investigation based on NVIDIA's objective inability to fulfill its commitments within the commitment period, implementing the rule of law with specific law enforcement practices. This is an effective response to NVIDIA's alleged violation of China's Anti-Monopoly Law, upholding the authority of the Anti-Monopoly Law and demonstrating independent professional judgment.
