For short period , we should be able to sell shares in pink sheet for 5 to 15 cents a share. I will sell some shares. Shorters need the shares to cover to avoid troubles. You can claim tax loss for 2024. No bother if you don’t really care remaining money, and you can discard anytime calling you broker.
The agreement tries to wipe shareholders and has not been through shareholder meetings. Thus a foundamental breach to loyalty. In other cases, debtor can do because: they bought the company with a token price, they have controlling shares, book value is near zero due to writing off, cash is low and will not make a pinciple payment. Material Default . SPIRIT apparently works with some UK investment bank who has foundament misinformation to US security laws. Yes in UK, but No in US. It will be very long story of fight.
Judge will decide this plan. Current plan is absolutely robbery, debt owners got company plus get new debt with the same principle. Do they really think judge is a fool or corrupted guy? However debtor in possesion is complete at that time, we can only get some payment for demage. DIP loan interest will drain remaining equity quickly. Therefore best case, we can clawback only probably small money and see CEO in jail. You won’t miss money if you sell tomorrow…
Anyway, don’t feel too bad. We will live longer and make way more money. Assholes will lose all. Exchange is not fool, they will not every allow SPIRIT back to exchange unless clean up all lawsuits. Just watch Luckin coffee. Judge is not fool. Only ETF and mutual fund managers will vote FOR. If you have connection, tell Trump, tell Musk.
