So, if it were you or me, would we rather intentionally not submit the problematic financial reports, or even destroy them, in order to deliberately provoke the SEC into delisting the company as a good way to avoid going to jail? In other words, the CEO would rather have the company delisted than not willing to submit the problematic financial data and end up in prison afterward.
