CHHB Clarifies On Two Cases Filed Against The Group

Country Heights Holdings Berhad has issued a statement regarding the company's recent legal proceedings, including two separate matters with the first case involving a winding-up petition by Mark Cellam and another by a contractor.

The petition it said stems from a fee demand for services related to an incomplete corporate exercise. Despite the nature of the proceedings and the incomplete status of the corporate exercise, CHHB said it acted responsibly to resolve the matter, fully settling its obligations to Mark Chellam in accordance with the company's principles of accountability and integrity.

In a separate case, Lean Xing Construction Sdn Bhd, a contractor for a residential project at Kolej Heights Utara, has filed a petition against Country Heights Smart Living, a subsidiary under CHHB.

The dispute it said concerns claims for unpaid sums related to the construction of 90 'Super-Linked Modern Contemporary' houses. CHHB clarified that the unpaid sums are tied to the ongoing Liquidated Ascertained Damages (LAD) and variable orders, which are yet to be finalised. As a result, the accounts related to this project remain open, and no payments can be made to Lean Xing Construction at this juncture pending the resolution and ascertainment of the LAD it said.

The Board of Directors of CHHB has decided to formally request Lean Xing Construction to withdraw the petition. Should they fail to do so, CHHB will be left with no option but to inform Bursa Malaysia of the potential reputational harm caused by this action.
